Estate Planning

Estate planning is the process of anticipating and arranging for the distribution of an estate. It helps eliminate the uncertainties involved in the administration of a probate and maximize the value of the estate by reducing taxes and other expenses. Estate planning is used to assure that the decadent’s assets will be distributed and dependents will be taken care of according to their wishes. As a rule of thumb you should update your Estate Plan every 3-5 years. You should also see an attorney to update your estate plan to reflect major life changes such as marriage, divorce, the birth of a child, home purchases, and a death in the family.

  • Trusts

In order to reduce the complication of the probate process, a trust can be created to ensure that your assets and real estate are distributed as you wish. The trust is a legal entity that exists even after you are gone and is used to avoid probate administration, ensuring your wishes are carried out and bypassing the lengthy probate process.

  • Wills

A will is used to name guardians for children, specify your final wishes, and distribute your estate to beneficiaries among other things. It is a fundamental part of any estate plan.

  • Advanced Health Care Directive and/or Durable Powers of Attorney

It is important to make your end-of-life wishes known. Advanced Health Care Directives and Durable Powers of Attorney can empower a trusted person to ensure that your wishes are fulfilled in the event you are unable to make these important decisions yourself.

  • Children

Estate plans provide peace of mind that your assets will be distributed and your children are provided for in the event that you are unable to.

  • Philanthropy and Planned Giving

Often clients want to leave behind a legacy in the form of philanthropic giving to their favorite charity, foundation, or organization. Giving to charity is subject to many rules and regulations which require solid structure and planning. Folsom Lake Law can help utilize creative and resourceful solutions to maximize the benefit of the gift, both for the client and for the recipient.

Folsom Lake Law offers multifaceted estate planning services that are individualized to your specific needs. We are very knowledgeable in the areas of estate planning and trust law. Trust Administration

Trust Administration is the process of administering a decedent's estate under the authority of their trust. It is similar in nature to a probate, excepting that a trust administration is not subjected to the cumbersome California probate code and courts. One of an estate plan's functions is to allow for the simpler process of trust administration and avoid probate.

Folsom Lake Law offers comprehensive trust administration services that are tailored to the unique needs of each trust. Our extensive experience in trust administration allows us to provide our clients with the best possible services.

Probate

Probate is the legal process of administering the estate of a deceased person by resolving all claims and distributing the deceased person's property under the valid will. This procedure is governed by an extensive code administered by the State of California. The complexity and stress of handling the administration of an estate is greatly reduced by hiring an experienced probate attorney.

Attorney fees and court costs are mandated by the State of California. Although all attorneys are compelled to charge the same fees, not all attorneys can offer the same quality service and expertise. Our goal is to limit both the delays and the expenses that are inevitable in the administration process. Folsom Lake Law is committed to serving as a probate resource to the community of Folsom, Sacramento and the surrounding areas.  We provide confidential, individualized counsel and advice to our clients.
